NCR FAQ: Why the need to survey my NCR land using Section 6 of the Sarawak Land Code?

Section 6 – Is for Sempadan Kampung through the New NCR Initiative Programme.

Section 18 – Is for individual NCR land boundary. Bila-bila boleh buat. 

Ikut keperluan masing-masing dan kesediaan kampung masing-masing.

Any case(s) of NCR land being surveyed directly using Section 18?

The new initiative of the Native Customary Rights (NCR) land surveying which uses Section 6 powers, started only in late 2010.

Section 18, existed far longer than that program. Some of our kampung lands got the individual titles back in 1990s surveyed straight under Section 18 of the Sarawak Land Code.

Of course. If you use the new initiative of the Native Customary Rights (NCR) land surveying, then section 18, is phase two of the program.

The New Initiative of NCR Land Survey Program was to accelerate the speed which Section 18 individual title can be given through a systematic approach.

There is no requirement for either one of Section 6 or Section 18 of the Sarawak Land Code to be done first.

The decision to do Section 6 first was an intra vires policy decision based on expediency. I was made to understand that if Section 18 was to be done first it would take 120 years to finish all the survey taking into account all the disputes and delays. 

By then a big junk of our NCR land might have been lost/abandon/untraceable etc. Thus the perimeter survey initiative was started by the Sarawak government to avoid all this.
